I del. pizzas while searching for a better job. I was written up for1.trying to rearend a car twice, driving like a maniac. I was behind this woman off "no tip road" and behind her for 3/10 of a mile. 2.went through 3 stop signs. there were 4 in her view (parked). total distance to watch me (5/8). 3.driving through arby's parking lot to avoid stoplight (i am guilty) 4.speeding (40mph in 25) over a speedbump. 5.went through a stopsign and cutting someone off. (false-i stopped and went into the centerlane, car let me in.)employee needed my schedule.I feel that 80% of my complaints were false. basket cases called in on me.i did 1800 deliveries in 4 locations(7towns) for 6 months.we had 10 drivers and i did 23% of the deliveries.I feel i was railroaded because i am 35yr old.I have a phone appeal with oklahoma unemployment. The internal controls were not being met. I turned in my $20 bag each night and 24 times it was short when i came in.(dishonest employees there) will i win?|||It will be a long shot... I've just went thru an appeal process and I'm 36 years (age dosn't matter), and was told to drop my case, but my employer never showed up for my appeal. The best advice given to me to be prepared for anything, the employer could call the lady your tried to rerend, you have the burden of proof, write a time line, were the police called about you tring to rerend the car, if you have a good (no tickets) driving record get a copy and a copy of your car insurance if you are in good standing and submit it, a copy of the employers handbook reguarding the procedures in turning in your bag.|||No- If they can prove your bag was short and that you had been warned prior to your firing- your claim will be toast.|||Doubtful. IN the end, it appears they terminated you for legitimate grounds.|||So I'm guessing that you freely admit to driving recklessly the other 20% of the time. I would hope that is against company policy. Being 35 years old just makes the matter worse, IMO.
How will you prove a dishonest employee shorted your bag. Didn't you count it before turning it in?
If I were your employer, I would fight you like crazy before allowing benefits.
